Service Agreement Form

Elite OTR Services is a mobile repair company whose purpose is to provide services for breakdowns over the road. Elite OTR Services will diagnose on-highway vehicles and make the best decision to determine what needs to happen to get the unit back up and running safely. If parts are available to be received upon diagnostics, there will be a $2.00 per mile additional fee to the original invoice mileage quoted upon the initial call. Parts that are incorrect or not ordered properly will be subject to a restocking fee.

Disclaimer

Not all vehicles can be repaired on the road depending on the circumstances. In such cases, Elite OTR Services has the ability to recommend wrecker services. Elite OTR Services, under no circumstances, will be held responsible for damage that has already occurred to the unit prior to service being provided. There will be no guarantees of fixing the unit on the side of the road. Elite will make educated decisions to provide excellent service to their customers. For customers that are out of fuel, please note that any and all damages done to a truck prior to our services showing up, such as over-cranking and damage to the battery, will be the customer’s responsibility. Elite OTR Services’ fuel call-out service will provide fuel and a way to prime the truck. It is the customer’s responsibility to pull to a safe area upon arrival for a fuel transfer. There will be a computer diagnostics fee if codes are present to ensure accurate diagnostics.

Deposits and Overdue Accounts

For service calls scheduled between 11:00 p.m. and 6:00 a.m., Elite OTR Services reserves the right to collect a $350 deposit prior to dispatch. This deposit is applied to the final invoice and is non-refundable once a technician has been deployed.

Payment is due upon completion of services unless other arrangements have been approved in writing by Elite OTR Services. Balances not paid within thirty (30) days will incur a late fee of five percent (5%) of the outstanding balance, assessed at thirty (30) days past due and monthly thereafter until paid in full.

If payment is not satisfied after services are completed, non-payment may constitute theft of services under applicable law. To the fullest extent permitted by law, Elite OTR Services may secure the vehicle or arrange for a wrecker to tow and hold the vehicle until the account is paid in full. The customer is responsible for all related towing, storage, and administrative charges.

Service Rates

There will be a daytime call-out fee, as well as a nighttime call-out fee.

There will be a 2-hour minimum fee for each call during the day and at night.

There will be a mileage fee associated with travel costs to and from the place of repair.

There will be a computer diagnostics fee associated with truck diagnostics, if applicable.

There will be an administrative fee associated with each call.

Parts will be added to tickets after diagnostics are completed.

There will be a 3 percent credit card fee for all card transactions.

Company Acknowledgement

The company or representative authorizes Elite OTR Services, upon agreed quote, to perform the diagnostics and/or work to be done to make a professional decision based on diagnostics that have been performed on any unit. The company or representative agrees that Elite OTR Services will not be held liable for loss or damage done to the unit, including theft, fire, or anything beyond Elite OTR Services’ control. The company or representative agrees that Elite OTR Services will not be responsible for any delay due to unavailable parts. The company or representative agrees that if repairs are halted for any reason, the company is liable to pay for services up to the time that they have been completed to that point. If, for any reason, invoice payment is rendered uncollectible, Elite OTR Services has authorization to source a wrecker to take ownership of the vehicle until the invoice is cleared with the accounts receivable department.
